Parenting orders - Can Grandparents and other extended family members apply?

The law in Australia now enables a Court to make parenting orders in favour of any of the following people:

  • either or both of a child's parents,
  • a child,
  • a grandparent of a child,
  • any other person concerned with the care, welfare or development of the child.

This means  there is a now a specific provision for grandparents to make an application for orders for their grandchild. Other extended family members could also apply on the basis that they are concerned with the “care, welfare or development” of a child. The types of parenting orders that can be applied for are as follows:

1. an order that deals with the person (or persons) with whom a child is to live,

2. an order which deals with the amount of time a child spends with another person (or other persons),

3. an order which deals with the allocation of parental responsibility and the form of communications to be had between persons who share that responsibility,

4. an order which deals with the manner in which a child is to communicate with another person (or persons),

5. a child maintenance order — which makes provision for the maintenance of a child,

6. an order which deals with the steps which must be taken before an application to vary an order is made,

7. an order which deals with the process to be used for resolving disputes about the terms or operation of the order,

8. an order which deals with any aspect of the care, welfare or development of the child or any other aspect of parental responsibility for a child.

All of these orders are classified as parenting orders.
