If your visa application is refused, you must contact us immediately for advice. The Migration Review Tribunal and Refugee Review Tribunal both have strict time limits within which applications for review must be lodged. These time limits cannot be extended.
The length of time you have to lodge an application in the Migration Review Tribunal and the Refugee Review Tribunal depends on the type of decision you are applying to have reviewed, whether you are in Australia or overseas and how you received the decision.
As at 29 December 2011, applications for review had to be filed in the Federal Magistrates Court within 35 days of the date of the migration decision. This time limit might have changed when you read this. In certain very limited circumstances the Court might extend this time limit, but the Court may refuse to consider your matter if you do not file in time - so you should always seek advice immediately you receive an adverse migration decision.
